Terms of Service

These terms govern your use of Stampd as a cafe owner who subscribes to the service. By creating an account or using Stampd, you agree to them. They form an agreement between your business and Stampd.
These terms are for the cafe (the subscriber). If you are a loyalty card member, the Privacy Policy explains how your data is handled.
The service
Stampd provides digital loyalty cards in Apple Wallet and Google Wallet, together with tools that help you retain customers and reports on how your loyalty programme is doing. We provide the service as it exists from time to time and may add, change, or remove features to improve it.
Your account and eligibility
You must be a business and at least 18 years old to open an account. You are responsible for your login details and for everything that happens under your account. Keep your password secure and tell us promptly if you suspect unauthorised access. The information you give us must be accurate and kept up to date.
Subscription and billing
- Stampd is a paid subscription, billed monthly or yearly, through our payment provider Stripe.
- Fees are charged in advance for the chosen period and, unless stated otherwise, are non-refundable for the period already started.
- Prices may change. We will give you reasonable notice before a change affects you, and a change takes effect at your next renewal.
- You can cancel at any time. Your subscription then runs until the end of the current paid period and does not renew. We do not delete your data immediately on cancellation; see Suspension and termination.
- You are responsible for any taxes due on top of the fees, unless we are required to collect them.
Acceptable use
You agree not to:
- Use the service for anything unlawful, deceptive, or harmful.
- Upload data you do not have the right to use, or that contains payment-card numbers or unnecessary personal data.
- Attempt to break, overload, reverse engineer, or gain unauthorised access to the service.
- Use the notifications or member communications to send marketing or spam. Wallet notifications are transactional only.
- Resell or sublicense the service without our written agreement.
Your responsibilities toward your members
You run the loyalty programme for your own customers. Where you and Stampd are joint controllers of member data, you remain responsible for your part. You agree to:
- Treat your members' data lawfully and only for running your loyalty programme.
- Honour the rewards and offers you advertise to your members.
- Make members aware of the Privacy Policy and respect their choices, including consent for optional details and requests to delete their data.
- Only upload sales data you are entitled to use, and avoid including cardholder names or card numbers.
Intellectual property
Stampd, its software, design, and brand belong to us. We grant you a limited, non-exclusive, non-transferable right to use the service while your subscription is active. You keep ownership of your own content, such as your logo, card design, and business data, and you grant us the right to host and process it so we can provide the service.
Disclaimers and limitation of liability
The service is provided on an "as is" and "as available" basis. Any estimates and revenue figures the service shows are projections to help you make decisions; they are not guarantees of results. We do not warrant that the service will be uninterrupted or error-free.
To the maximum extent permitted by law, Stampd is not liable for indirect, incidental, or consequential losses, or for lost profits or revenue. Our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law.
Suspension and termination
You may stop using the service and cancel at any time. We may suspend or terminate your access if you breach these terms, fail to pay, or use the service in a way that risks harm to others or to the service. Where reasonable, we will give you notice and a chance to fix the problem first.
After termination we will, within a reasonable period and in line with the Privacy Policy, reduce or delete your data. You can ask us to delete it sooner.
Changes to these terms
We may update these terms as the service or the law changes. We will update the date at the top and, for material changes, make the update clear. Continuing to use the service after a change means you accept the updated terms.
Governing law
These terms are governed by the law of the Netherlands. Any dispute will be subject to the jurisdiction of the competent courts of the Netherlands, unless mandatory law gives you the right to bring it elsewhere.
